Leads patent dispute with Barberán

A patent is an industrial property right for an invention granted by a sovereign body. The owner of the patent is entitled to prohibit others from using the invention. Unfortunately, from the point of view of Hymmen GmbH from Bielefeld, there have recently been patent infringements by competitors in the field of digital printing. As a result, the Westphalian company saw itself forced to file a lawsuit. The following information was provided today by Dr. René Pankoke, managing partner and CEO of Hymmen:

“Already since 2007 Hymmen has been active in research and development in the field of industrial digital printing. Already at that time we were of the opinion that among others the production of digitally printed laminate flooring as well as other surfaces would become more and more popular in the future. The expected market development actually started. With our own development department and our specialists, we constructed digital printing systems, which we then presented at the ‘Ligna’ 2009.

Currently, we are assuming a worldwide production of printed surfaces on Hymmen ‘Jupiter’ digital printing systems of well over 100 million square meters per year. Digital printing will be the future of the market worldwide.

In the last 13 years Hymmen has invested a lot of effort in research and development for its customers, has developed several new processes and has applied for numerous industrial property rights to protect its intellectual property. In the area of digitally printed surfaces alone, including the digital structuring of surfaces, Hymmen currently has a large number of national and international applications for industrial property rights, a large number of which have already been granted after corresponding examination by the responsible authorities.

For us as a supplier of industrial digital printing systems, it is important that our machine and system customers as well as our partners from the paint manufacturer sector can safely operate their systems or sell their paint materials. We are at your side with our experience and competence to achieve this.

For this reason, our experts regularly monitor our competitors and other players in the market for decorative and digitally printed surfaces. Where we consider it essential, we will also defend our intellectual property significantly. For your information we would therefore like to inform you about the following current decision from Hymmen: On April 14, 2020 Hymmen GmbH filed a patent infringement suit against Barberán S.A. at the Regional Court Düsseldorf (file no. 4b O 26/20). This concerns the infringement of two industrial property rights of Hymmen GmbH:

The first patent is the German part of the European patent ‘EP 3 109 056’. The German file number is DE 50 2016 000 571.0. This patent is granted and in force. An opposition procedure against the patent is currently in progress, but Hymmen GmbH is fully convinced that the patent will be maintained in the result.

The patent protection relates to a process for producing a structure on a surface of a flat workpiece and a device for producing this structure. The offer of devices of the series ‘Jetmaster’ of Barberán S.A., which – especially under the designation ‘Jetmaster TXT’ or ‘Jetmaster TRT’ – serve to apply the patented structure coating as so-called ‘True Texture’ property, is attacked.

The second patent at issue is the German part of the European patent EP 2 313 281. The German file number is DE 50 2010 001 024.6. This patent has also been granted. After conclusion of an opposition procedure, the European Patent Office maintained the patent of action with minor amendments by decision of 14.12.2014. The appeal directed against this decision was withdrawn by the opponent. The opposition proceedings in this case have thus been finally and conclusively concluded. This patent is asserted against Barberán S.A. in the version confirmed by the opposition division.

The patent protection concerns a process for the decorative coating of flat workpieces. Barberán S.A. devices are attacked, for example devices from the series ‘Jetmaster 1260’ or ‘Jetmaster 1890 single pass’.

An extension of the infringement action to further industrial property rights of Hymmen GmbH is basically possible.

Unfortunately, due to the activities of Barberán S.A. since last year 2019, we see ourselves forced to take this step in order to protect the interests of Hymmen GmbH as well as those of our customers and our partners on the side of the paint manufacturers.

As far as this will be necessary in the future, we will file further patent infringement suits against other market participants if necessary”.

British Lux Group takes over the traditional kitchen brand

The deal surrounding the pending sale of Poggenpohl Möbelwerke, which has been insolvent since April, is as good as concluded: The British Lux Group Holdings Ltd. will take over the Herford-based company in partnership with the German Wolf family of entrepreneurs. The group, whose portfolio already includes luxury kitchen brands such as Smallbone, Mark Wilkinson and Brookmans, will acquire Poggenpohl (“the oldest and best-known kitchen brand in the world”) as part of a transferring restructuring. The asset purchase includes the plant in Herford as well as the international subsidiaries. The Poggenpohl creditors’ committee has approved the acquisition. The final contract is to be signed by the end of this month. The parties have agreed not to disclose the purchase price.

The provisional insolvency administrator Manuel Sack from the law firm Brinkmann & Partner is satisfied: “With The Lux Group, we have gained a strategic investor for Poggenpohl and thus secured the Herford location. We are convinced that The Lux Group will further enhance the global appeal of this traditional brand. Negotiations on only a moderate personnel adjustment will be conducted with the works council in the coming days. The international investor process was conducted with great commitment and professionalism by PwC”.

Poggenpohl Managing Director Gernot Mang, who will continue to lead the team, explains: “Our future plans include further developing the luxury kitchen segment, expanding the categories and providing a ‘best-of-class’ luxury experience. We expect our high-quality dealer network to play a key role in the renewal of the premium Poggenpohl brand. Together with the joint venture team, we will reinvent the kitchen industry.

The Wolf family of entrepreneurs will provide support as a financial investor and also act as the German partner of the Lux Group. RIB Software SE and Microsoft will be the strategic technology partners to deliver the most advanced disruptive cloud-based platform technology. The group is ready to digitally transform the $100 billion global kitchen industry, just as Tesla did in the automotive industry. These are the ambitious plans.

After all, the Lux Group wants to invest more than 50 million euros to revive the internationally renowned traditional German brand Poggenpohl, it was recently announced. The listed company RIB Software SE, with its headquarters in Stuttgart and international branches, has worldwide contacts in the construction industry and counts large construction companies among its customers.

Expects economic situation to remain tense

Even though it is difficult to forecast the global economic situation in the coming months, the fittings manufacturer Blum from Vorarlberg is expecting a period of economic weakness that could last for a longer period of time. Compared to the severely affected months of April and May, the company sees positive signs in various international markets in June. However, an overall recovery of the global economy is not yet in sight. Nevertheless, Blum has gradually increased the operational capacities in most of the company’s divisions to full capacity again in recent weeks.

Due to the uncertain economic situation, the company has decided to extend short-time work over the summer months as a safety net. The family-owned company thus considers itself well prepared for any renewed critical developments. “We are pleased with this model and at the same time hope that we will not have to make use of state support if at all possible”, explains Managing Director Philipp Blum. “For us, the responsibility towards our employees is the most important thing. We are pleased that we feel the strong support of our employees especially now”.

As for many companies worldwide, the past months have been very intensive for Blum. At the end of March, the company reduced its operations to a minimum level for three weeks in order to protect the health of its employees. Since mid-April, Blum has been taking cautious steps to open the plant. In June, the fittings expert was able to increase the operational activities to a familiar level for the most part. In doing so, the continuous supply of worldwide customers was ensured at all times.

"Paintexpo" 202

Organizer confirms date in mid-October

After the relaxation and positive developments of recent weeks, the organisers of “Paintexpo” are now planning to hold the fair from 12 to 15 October 2020: “Due to the postponement from April to October, there have been some cancellations by exhibitors due to scheduling problems, but more than 500 exhibiting companies from Germany and abroad will be represented in Karlsruhe,” reports Jürgen Haußmann, Managing Director of the private fair organiser Fairfair GmbH. “We are very pleased that exhibitors and visitors as well as partners now have planning security again”.

The trade fair organiser and his team consider themselves well prepared for the event. Together with Messe Karlsruhe and the relevant state and local authorities, a comprehensive hygiene and safety concept for maximum health protection for exhibitors and visitors will be developed, which can be adapted to current conditions at any time. “Among other things, the concept ensures that there is at least four square metres of space per visitor, even on busy days,” adds Jürgen Haußmann. A further aspect is the exclusive online ticket sale or the online redemption and registration of admission vouchers. “In accordance with the security concept, day ticket offices are not provided,” the organizer notes.

With their range of products and services, the exhibitors completely cover the process chains for wet painting, powder coating and coil coating. Areas such as digital transformation, solutions for automation and simplified robot programming, the improvement of energy and resource efficiency or even the metallization of surfaces are just some of the topics that will be in the spotlight. The world’s leading trade fair thus enables contract coaters and in-house coating companies from all sectors to obtain specific information about new developments, trends and technologies for coating components and substrates made of all materials. At the same time, the world’s leading trade fair is the ideal opportunity to exchange information and network – among other things, to make possibly fragile supply chains more stable and sustainable.

The American mega-event is cancelled

Due to the Covid 19 pandemic, the “International Woodworking Fair” (IWF), which was to take place in Atlanta from 25 to 28 August, was cancelled. This was decided after intensive consultations between the “IWF” Show Management Team and the “IWF” 2020 Management Committee, whose members represent the Wood Machinery Manufacturers of America and the Woodworking Machinery Industry Association.

The conditions created by Covid-19, including accompanying travel restrictions and federal, state and local government regulations, made it impossible to hold the show without endangering the health and safety of all exhibitors, attendees and the Atlanta community as a whole.

Registered participants of “IWF 2020” will be notified by “IWF” on June 19 of all details regarding the refund of registration fees and hotel room cancellations.

The next “IWF” will take place from August 23 to 26, 2022.

Not applicable due to unclear rules for the exhibition sector

Due to the continuing corona situation, the “Sicam” has decided to postpone the event in northern Italy until October 2021. The postponement by one year has been decided in order to leave the annual exhibition calendar unchanged and to offer the wood industry the best possible service.

“Unfortunately, during these months there has been a lack of clear rules and protocols at all legislative levels in the exhibition sector, making it impossible to organise an event that is profitable for exhibitors and visitors in what is already a very difficult and complex period,” says the official statement.

The 12th edition of the International Exhibition of Components, Accessories and Semi-finished Products for the Furniture Industry will therefore take place from Tuesday 12th to Friday 15th October 2021 at the well-established venue of the Pordenone Fair.

How nations invest in robotics research

International Federation of Robotics IFR: How Nations Invest in Robotics Research

The Corona crisis highlights the important contribution that robots make to industry and to society. Research funding programs (R&D) are vital to enable and further support these developments. IFR summarized national funding programs in the new “World Robotics R&D Programs”.

New technologies, such as Artificial Intelligence, Big Data and 5G, drive government funding in Asia, Europe and America. What are the targets of the officially driven government research funding programs and what can we learn from these findings? This has been researched by the International Federations of Robotics and published in the new paper “World Robotics R&D Programs”.

“Each country has its own characteristics of robot programs based on its specific background and history,” says Prof. Dr. Jong-Oh Park, Vice-Chair IFR Research Committee and member of the Executive Board. “Therefore, we see that robotics programs set up by the most advanced robotics countries have a very different strategic focus.”

The strategic plan Made in China 2025 comes as a blueprint to upgrade the manufacturing capabilities of Chinese industries. This includes advanced robots among the top 10 core industries. The Robot Industry Development Plan sets out the goals for China in 2020, including: (1) developing three to five globally competitive robot manufacturers, (2) creating eight to ten industrial clusters, (3) achieving 45% of domestic market share for China’s high-end robots, and (4) increasing China’s robot density to 100 robots per 10,000 workers. The statistical yearbook “World Robotics” by IFR shows that China reached a robot density of 140 units per 10,000 workers in the manufacturing industry in 2018. In 2019, the Chinese government invested 577 million USD in the development of intelligent robots.

The New Robot Strategy in Japan is a key policy of the Abenomics Growth Strategy. The robot-related budget for 2019 has been increased to 351 million USD, with the aim to to make Japan the robot innovation hub in the world. The action plan includes manufacturing as well as important service sectors like healthcare, agriculture and infrastructure. According to the statistical yearbook “World Robotics” by IFR, Japan is the world´s number one industrial robot manufacturer and delivered 52% of the global supply in 2018.

The Intelligent Robot Development and Supply Promotion Act of Korea is pushing to develop the robot industry in Korea as a core industry in the fourth industrial revolution. The 3rd basic plan for Intelligent Robots published in 2019 promotes systematic selection and concentration of promising public and private sectors. Focus areas are: manufacturing businesses, selected service robot areas (including healthcare and logistics), next-generation key components and key robot software. The robot-related budget for 2020 is 126 million USD (151 billion won). The statistical yearbook “World Robotics” showed a new record stock of about 300,000 operational industrial robots in the Republic of Korea in 2018 (+10%). Within five years, the country has doubled its number of industrial robots in operation. Following Japan and China, the country ranked third in 2018.

Robotics projects funded by Horizon 2020, the European Union´s 8th Framework Program, represent a wide variety of research and innovation topics – ranging from manufacturing, commercial and healthcare use to consumer, transportation, and agri-food robotics. Through this program, EC provides an estimated 780 million USD funding for robotics research and innovation over its seven-year runtime. The main topics of the Work Program 2018-2020 are related to digitization of industry through robotics, robotics applications in promising new areas, and robotics core technologies such as AI and cognition, cognitive mechatronics, socially cooperative human-robot interaction, and model-based design and configuration tools with the total budget of 173 million USD.

As part of its High-Tech Strategy, Germany support the use of new digital technologies within industry and administration. The “PAiCE” program with a funding budget of 55 million USD (50 million euros) over five years emphasizes the development of digital industry platforms as well as collaboration between companies using these platforms. In particular, the robotics-oriented projects are focusing on the creation of platforms for service robotics solutions in the various relevant application areas including service, logistics, and manufacturing fields. Germany is the fifth largest robot market in the world and number one in Europe, followed by Italy and France. In 2018, the number of robots sold increased by 26% to almost 27,000 units – a new all-time record.

The National Robotics Initiative (NRI) in the USA was launched for fundamental robotics R&D supported by the US Government. The main goals focus on fundamental science, technologies, and integrated systems needed to achieve a vision of ubiquitous collaborative robots assisting humans in every aspect of life. Moreover, in NRI-2.0, collaboration between academia, industry, non-profit, and other organizations is encouraged. The budget of NRI for 2019 is 35 million dollars. Additional robotics funding for application in defense and space is provided through the Department of Defense (DoD) and the Mars Exploration Program. According to the statistical yearbook “World Robotics”, robot installations in the United States increased for the eighth year in a row to a new peak in 2018. Regarding annual installations, the country has taken third position from the Republic of Korea.
